Terms of service
Overview
This website (averageboatguy.com) is operated by Short Beach Marine Corp. (“Average Boat Guy,” “we,” “us,” or “our”). By visiting our site and/or purchasing from us, you agree to these Terms of Service and to our Refund and Shipping policies.
Please read them carefully. If you do not agree, do not use this site or place an order.
Online store terms
By using this site you represent that you are at least the age of majority in your state of residence, or that you are the age of majority and have given consent for any minor dependents to use the site.
You may not use our products or site for any illegal or unauthorized purpose, or violate any laws in your jurisdiction (including copyright laws). A breach of these Terms may result in immediate termination of your access to our services.
General conditions
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service without our express written permission.
Product information, fitment, and accuracy
We make reasonable efforts to display products accurately. Colors, images, specifications, and packaging can vary. Many marine parts are vehicle- or engine-specific. You are responsible for confirming fitment (engine model, serial number, hull, year, and related specs) before ordering and before installation. Contact us if you need help verifying a part.
We do not warrant that product descriptions, pricing, or other content is error-free, complete, current, or accurate. We reserve the right to correct errors, update information, and cancel orders if information was inaccurate, including after an order has been submitted.
Installation, wiring, plumbing, and safety-equipment use must follow manufacturer instructions and applicable USCG / local rules. Improper installation or use is at your own risk.
Prices and billing
Prices are shown in US dollars and may change without notice. We reserve the right to refuse or cancel any order. In the event of a pricing or inventory error, we may contact you for instructions or cancel the order and refund amounts paid for the canceled portion.
You agree to provide current, complete, and accurate purchase and account information for all orders.
Shipping; title and risk of loss
Shipping terms are described in our Shipping policy. Title and risk of loss for shipped goods pass to you upon delivery to the carrier, except where required otherwise by law. Dropshipped items may ship from a supplier warehouse.
Returns and refunds
Returns and refunds are governed by our Refund policy. Hazardous materials, flares (pickup-only), special orders, and other excluded categories follow that policy.
Third-party tools and links
We may provide access to third-party tools or links. We do not monitor or have control over them and accept no liability arising from your use of optional third-party tools or external sites. Use them entirely at your own risk.
Manufacturer warranties
Many products carry a manufacturer’s warranty. Warranty service for defects after the return window (or for installed/used items) is generally handled by the manufacturer under their terms. We can help point you to warranty contacts when possible.
Disclaimer of warranties; limitation of liability
Except as expressly stated in our policies or required by law, this site and all products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
In no case shall Average Boat Guy, our directors, officers, employees, affiliates, agents, contractors, suppliers, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost data, or replacement costs, arising from your use of the service or any product purchased, including marine, electrical, or safety equipment, whether based in contract, tort, strict liability, or otherwise — to the fullest extent permitted by law.
Because some jurisdictions do not allow the exclusion or limitation of certain damages, our liability in those jurisdictions shall be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Average Boat Guy and our affiliates, officers, agents, and employees from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted and the unenforceable portion shall be deemed severed. The remaining provisions shall continue in effect.
Governing law
These Terms and any separate agreements under which we provide services shall be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Venue for disputes shall be in the state or federal courts located in New Jersey, unless applicable law requires otherwise.
Changes to terms
We may update these Terms at any time by posting changes on this page. Your continued use of the site or purchase after changes constitutes acceptance of the revised Terms.
